Milanity’s Data Usage and Privacy Policy

This communication informs you of our policies regarding the collection, use, and disclosure of personal data and the choices you have agreed upon by using our Products and Services. User data protection and privacy is our top priority and we take precautionary steps as we build and evolve.

    Milanity has implemented technology and security features to safeguard the privacy of your personal information. A secure server protects your personal information. Additionally, with Milanity you can be assured that the information you provide to Milanity is transmitted using Secure Socket Layer (SSL) encryption. If you become aware of any security breach, please let us know as soon as possible.

    We have internal procedures in place requiring our employees and data processors to respect the confidentiality of any personal or commercial information held by Milanity. We restrict access to customers’ personal and commercial information to Milanity employees, contractors and agents who need to know that information in order to process it in connection with the Service, and who are subject to strict contractual confidentiality obligations and may be disciplined or terminated if they fail to meet these obligations.

    Milanity will endeavor to take all reasonable steps to keep secure any information that we store about you. Your information is stored on secure servers that are protected in controlled facilities. Milanity will not be held responsible for events arising from third parties gaining unauthorized access to your personal information, or people with access exceeding their authority.

    Please note also that Milanity may use overseas facilities to process or back up its information. As a result, we may transfer and store your personal information in such overseas facilities. However, this does not change any of Our commitments to safeguard Your privacy.

  6. Secure Product Build

    All information security and data security protocols are incorporated in every release cycle and is a part of the blueprint considerations of all products.

    Product roadmap is well defined by the Product Owner in all phases of development. Security patches are given top priority and are bundled in the earliest possible rollout. All product builds are put through stringent functionality tests, performance tests, stability tests, and UX tests.

    We follow blue-green deployment strategy for deployment of changes to production environment that allows us to deploy upgrades in a seamless manner.

  7. Tracking & Cookies Data

    We use cookies and similar tracking technologies to track the activity on our service and hold certain information. Cookies are sent to your browser from a website and stored on your device. Tracking technologies also used are beacons, tags, and scripts to collect and track information and to improve and analyze our service.

    To provide and maintain the service.

    To notify you about changes to our service.

    To allow you to participate in interactive features of our service when you choose to do so.

    To provide customer care and support.

    To provide analysis or valuable information so that we can improve the service.

    To monitor the usage of the service.

    Milanity will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy. No transfer of your Personal Data will take place unless there are adequate controls in place including the security of your data and other personal information.

    The security of your data is important to us but remember that no method of transmission over the Internet, or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your Personal Data, we cannot guarantee its absolute security.

  11. Data Backup

    We run incremental backups every day and full back up once a week. Backup data is stored in the same location and are encrypted at rest, same as the original data. We additionally restore and validate backups every week. All backed up data is retained only for three months.

    If a customer requests for data recovery within the given retention period, we will restore their data from the backup and make it available to them.

  12. Changes to This Privacy Policy

    We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on our web page.

    We will let you know via email and/or a prominent notice on our service, prior to the change becoming effective and update the "effective date" at the top of this Privacy Policy.

    You are advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted on this page.

Terms of Service

Terms of Service

By accepting the Terms of Service of Milanity’s tools and services, you acknowledge that you have read, understood and agreed to be bound by the following terms. If you are entering these terms on behalf of an employer or third party, you represent that you have authority to bind that entity to these terms. If you do not have such authority or do not agree to the Terms of Service, you cannot use the SERVICES PROVIDED BY MILANITY.

  1. Accounts

    When you SIGNUP for an account with us, you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service. You are free to refuse our request for your personal information, with the understanding that we may be unable to provide you with some of the desired services.

    You are responsible for safeguarding the password that you use to access the Tools and Service and for any activities or actions under your password.

    You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

  2. Fees and Payments

    There will be usage/subscription fees for all Tools provided by Milanity in different payment methods and cycles. If Customer chooses to add or remove services, Customer authorizes Milanity to modify charges appropriately for the upgrade and premium services. Customer further authorizes Milanity’s use of third party payment processors, and consents to the disclosure of Customer's payment information to such third party. All payment obligations are non-cancelable, and all amounts paid are non-refundable.

  3. Subscription Term and Renewal

    The Subscription term (such as monthly or annually) shall be determined on a case by case basis based on the products or services selected by the customer. Unless either party gives the other written notice that it does not intend to renew the Subscription Service, this Agreement will be automatically renewed.

    The Subscription Service

    a. Access – Milanity allows access to Users based on Usage and Subscription Service terms as agreed upon.

    b. Limits - Milanity may limit the use of certain features of the Subscription Service in its sole discretion. Milanity may suspend, limit, or terminate the Subscription Service for any reason at any time with or without any notice. If Subscription Service is terminated by Milanity after it is paid for by the customer, Milanity will refund the Customer for the unused portion of the Subscription Service.

    c. Modifications - Milanity reserves the right to modify the Subscription Service from time to time, including by adding or deleting features and functions, in an effort to improve its customers’ experience. Nothing in this Agreement shall prohibit Milanity from making such changes to the Subscription Service.

  4. Customer, User, and Personal Data

    Milanity may monitor use of the Subscription Service by all of its customers and use data related to such use in an aggregate and anonymous manner, including to compile statistical and performance information related to the provision and operation of the Subscription Service. Customer agrees that Milanity may use and publish such information, provided that such information does not incorporate any Customer Data or identify Customer.

    Milanity DISCLAIMS ANY AND ALL LIABILITY THAT MAY ARISE FROM CUSTOMER’S USE OF THE SUBSCRIPTION SERVICE TO COLLECT OR MANAGE SENSITIVE INFORMATION. CUSTOMER AGREES NOT TO USE THE SUBSCRIPTION SERVICE TO COLLECT, MANAGE OR PROCESS SENSITIVE INFORMATION.

    Milanity may collect, use, process, store, and share certain Customer Data, Sensitive Information, and Personal Data in connection with providing the Subscription Services. Any such collection, use, processing, storing, or sharing is subject to the terms and conditions of Milanity’s Privacy Policy (URL). Customer agrees that Customer Data, Sensitive Information, and Personal Data may be collected and used by Milanity in connection with the Subscription Services and Customer hereby consents to such use and collection.

  5. Publicity

    If Milanity wishes to publish Customers’ name and logo on its website or on social media, it will do so only after obtaining permission from the Customer to publish such information.

  6. Acceptable Use of Communications Services

    Customer agrees to the communication methods adopted by Milanity and its Service Providing Partners in managing customer support and promoting Milanity’s products. Milanity and Service Providing Partners disclaims any and all liability with regards to the Communication Services.

  7. Milanity’s Proprietary Rights

    This is an Agreement for access to and use of the Subscription Service. The Customer is not granted a license to any software by this Agreement. The Subscription Service, including all intellectual property rights therein and derivatives and modifications thereto, belong to and is the property of Milanity. The Milanity Content should not be copied, reproduced, modified, published, uploaded, posted, transmitted, performed, or distributed in any way, and Customer agrees not to modify, rent, lease, loan, sell, distribute, transmit, broadcast, or create derivative works based on the Milanity Content, or the Subscription Service in whole or in part, by any means, except as expressly authorized in writing by Milanity.

  8. WARRANTY AND DISCLAIMER

    Milanity shall use reasonable efforts consistent with prevailing industry standards to maintain the Services in a manner which minimizes errors and interruptions in the Services and shall perform the Services in a professional and workmanlike manner. Services may be temporarily unavailable for scheduled maintenance or for unscheduled emergency maintenance, either by Milanity or by third-party providers, or because of other causes beyond Milanity’s reasonable control, but Milanity shall use reasonable efforts to provide advance notice in writing or by e-mail of any scheduled service disruption. However, MILANITY does not warrant that the Services will be uninterrupted or error free; nor does it make any warranty as to the results that may be obtained from use of the Services. EXCEPT AS EXPRESSLY SET FORTH IN THIS SECTION, THE SERVICES AND IMPLEMENTATION SERVICES ARE PROVIDED “AS IS” AND MILANITY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

  9. Termination and Expiration

    Either party may terminate this Agreement at any time upon notice. Immediately upon termination or expiration of this Agreement, Milanity shall cease all use of the Subscription Service and if requested by the customer in writing, destroy all Customer’s data in its possession.

  10. Support

    Milanity’s Customers have access to Milanity’s Customer Support via Support Ticket and will be communicated with through mobile app, email, mobile text message, phone call or any other medium to resolve the case. The Customer also has access to the tutorial and knowledge base of Milanity.

  11. Changes

    We reserve the right, at our sole discretion, to modify or replace the Terms of Service at any time. If a revision is made to the Terms of Service, we will provide a notice at least 15 days prior to any new terms taking effect.

    By continuing to access or use our Service after revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are requested to stop using the Service.
